NEW BUSINESS

1. Special Land Use Request -- Michael Pondo, 1075 Roberts Road

   1. Owner requests withdrawal of request pending family dispute re: use of the property.

   2. Township Planning Consultant Dick Smith of Montgomery & Assoc. suggests we first read aloud the letter from township attorney John McNamee regarding this Land Use Request

   3. This letter outlines that the owners are not in agreement on the use of their land; attorney recommends they resolve their differences before coming before this board; in the meantime, they should cease and desist unauthorized activity at this site.

   4. Motion by Bill Drake: Table this Special Land Use request per attorney’s recommendation Second by Pat Runyon Motion Carried

   5. Motion by Bernie Pelc: Receive & file this communication from the attorney Second: George Kunnath Motion Carried

   6. Mr. Smith suggested the applicants start anew in the future

   7. Board members suggested they review appropriate ordinances

   8. The point was made by applicants that anyone conducting outdoor sales should be accountable to the same ordinances, as there are others doing so.

   9. Some discussion followed regarding what is allowed in B-2 zoning.

A resident asked what will happen to the wood that is already there; Building Inspector Klaasen referred to the attorney’s letter (cease & desist). This could end up in court for resolution unless the owners resolve it.

2. Reminder of Public Hearing for “Renewable Wind Sources-Wind Generators Ordinance” scheduled for May 26, 2010

Motion by: Mary Agnes Simons to cancel Public Hearing until township attorney has chance to review it Second: Bill Jenuwine Motion carried

OLD BUSINESS

1. Review of proposed “Outdoor Burning, Open Burning, and Wood-Fired Boiler Ordinance”

a. Bill Drake suggests we have fire chief’s involvement before making final decisions on this ordinance.

b. Mr. Smith led partial review of proposed ordinance.

c. Chair is noting areas to be reviewed by attorney and/or fire chief

2. Review of proposed grading & drainage regulation ordinance
